To elect to participate in the general election, a section 501(c)(3) organization must submit the following items with its Form 990-EZ filed by Jan. 31, 2025 and each subsequent timely thereafter: • A certificate signed by the organization's Chief Executive Officer authorizing the organization to participate in the election; • A tax identification number (TIN) assigned by the Internal Revenue Service for use in accordance with Internal Revenue Code section 5053(a)(3)(B) (ii) and (iii); • A certification that the organization has complied with the procedures and requirements imposed by the regulations implementing § 501(c)(3) on the return or return-in-lieu of return of the election; and • A certification that the total amount of expenditures made by the organization during the taxable year cannot exceed 25,000, exclusive of amounts spent for legal, accounting, accounting-related, or similar services and expenses. Sec. 3-a. In addition to participating in the general election, a section 501(c)(3) organization shall ensure that each calendar year, all the organization's officers and employees who are eligible to vote on any matter relating to the organization's tax exemption, and all employees of the organization who are not eligible to vote, are notified that the organization is making or will make an election under section 501(h) of the Internal Revenue Code from which the organization will be revoking its election to participate in the general election. The notification must be sent within 15 days of a change in the number or election date for which the election is made. Sec.
